Terms of Use

These Terms of Use ("Terms") govern your use of the Nocta mobile application ("Nocta", "the app", "we", "our"). By downloading or using Nocta, you agree to these Terms. If you do not agree, please do not use the app.

Quick summary: Nocta is provided as an AI-powered journal app. You use it at your own discretion. Subscriptions are billed by Apple. We are not liable for indirect damages. Your privacy is governed by our Privacy Policy.

1. Eligibility

You must be at least 13 years old to use Nocta. By using the app, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. License to Use the App

Nocta is licensed, not sold. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, solely for your personal, non-commercial use, subject to these Terms and to Apple's Standard End User License Agreement, which is incorporated by reference.

3. Your Content

Photos, notes, and journal entries you create with Nocta belong to you. You retain all rights in your content. Because your content is stored locally on your device, we do not claim any license to it.

When you generate a journal entry, your photo, selected emotion, and optional note are transmitted to our backend and to our AI provider solely for the purpose of producing the journal text. We do not retain that content on our servers after the response is returned. For details, see the Privacy Policy.

4. Acceptable Use

You agree not to:

Use the app to create or transmit content that is illegal, infringing, defamatory, hateful, or sexually explicit involving minors.
Attempt to reverse-engineer, decompile, or extract source code, except as expressly permitted by law.
Interfere with or disrupt the app's servers or networks, or attempt to gain unauthorized access.
Use the app to generate content that you intend to pass off as written by a third party in a misleading way.

We may suspend or terminate access if you violate these rules.

5. Subscriptions and Payments

Nocta offers a free tier and may offer paid subscription plans (such as Basic or Premium). Paid subscriptions are billed through your Apple ID account.

Billing: Payment is charged to your Apple ID at confirmation of purchase.
Auto-renewal: Subscriptions automatically renew at the end of each billing period at the then-current price unless auto-renewal is turned off at least 24 hours before the period ends.
Manage / cancel: You can manage and cancel subscriptions in iOS Settings > Apple ID > Subscriptions. Cancellation takes effect at the end of the current period.
Refunds: Refund requests are handled by Apple at reportaproblem.apple.com. We do not process refunds directly.
Free trials: If a free trial is offered, you will be charged at the regular price when the trial ends unless you cancel beforehand.

6. AI-Generated Content

The journal entries Nocta produces are generated by AI based on the inputs you provide. AI output may be inaccurate, incomplete, or unexpected. You are responsible for reviewing the generated text before relying on it, sharing it, or treating it as a record of fact. We make no warranty that AI output will be accurate, suitable, or free from error.

7. Service Availability

We aim to keep the app and its journal generation service available, but we do not guarantee uninterrupted availability. The service may be unavailable from time to time due to maintenance, network issues, or factors outside our control. AI-related features depend on third-party providers (Google's Gemini, Anthropic's Claude, and OpenAI's GPT) whose availability is also not guaranteed.

8. Disclaimers

NOCTA IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS OR THAT IT WILL BE ERROR-FREE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY ARISING FROM OR RELATING TO THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM, OR USD 50, WHICHEVER IS GREATER.

Nothing in these Terms limits liability that cannot be excluded under applicable law.

10. Apple-Specific Terms

You acknowledge that these Terms are between you and us, not with Apple, and that Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support services for the app. Apple is a third-party beneficiary of these Terms and may enforce them against you.

11. Termination

You may stop using Nocta at any time by uninstalling the app. We may suspend or terminate your access if you violate these Terms or if we discontinue the app. Sections that by their nature should survive termination (such as Disclaimers, Limitation of Liability, and Governing Law) will survive.

12. Changes to These Terms

We may update these Terms as the app evolves. Material changes will be announced in the app or on this page. The "Last updated" date above always reflects the current version. Continued use of the app after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of Japan, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of Nocta will be subject to the exclusive jurisdiction of the courts located in Tokyo, Japan, except where mandatory consumer protection laws of your country of residence apply.
